- Fail to comply with the terms and conditions of any third-party platform provider through which you access and/or use the Services, including all terms and conditions applicable to any payments you make through any platform or to us.
- Interfere with or disrupt other players' use of the Services, including disrupting normal game play or game mechanics, chat, or conversation, such as by using vulgar, offensive, or harassing language, abuse, excessive shouting (all caps), spamming, flooding, repeatedly pressing the Enter key, or engaging in similar conduct.
- Harass, threaten, bully, humiliate, spam, or engage in any other conduct that may offend or be objectionable to other players or our employees (including customer service personnel), such as repeatedly sending unwanted messages, using vulgar language, making threats, or making discriminatory remarks about race, sexual orientation, religion, cultural background, etc.
- Improperly use in-game support or complaint buttons, or submit false reports to customer service.
- Attempt to obtain or phish for passwords, account information, or other private information from any other user of the Services or from our employees.
- Use or distribute unauthorized software programs or tools, such as "auto" software programs, "macro" software programs, "cheat tool" software programs or similar applications, exploits, cheat programs, or any other game cracks, modifications, or cheat software or tools, including "tricks" or "cheats" intended to obtain discounts or free virtual goods or virtual items (as defined below).
- Modify any files or any other part of the Services without our express authorization.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless us, our current and future affiliates, parents, and licensors, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, insurers, and reinsurers, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to these Terms, your use of the Services or any part thereof, your posting of User Content, or your violation of these Terms. You agree to cooperate in the defense of any action covered by this section.
Nothing in these Terms affects your statutory rights as a consumer of the Services. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In these jurisdictions, the following exclusions and limitations apply only to the extent permitted by the laws of such jurisdictions.
Disclaimer – You assume all risk of accessing and using the Services. We provide the Services on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind.
We make no representations or warranties of any kind, express or implied, regarding the operation of the Services, or the information, content, materials, products (including software), or other services included on or made available through the Services. As noted above, the performance of the Services may be affected by your hardware, software, internet access, or other factors, all of which are beyond our control. In addition, we may suspend, withdraw, or restrict the availability of all or any part of the Services at any time and for any reason.
You expressly agree that your use of the Services is at your sole risk. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding the Services, including any warranty of merchantability, fitness for a particular purpose, title, or non-infringement, or any warranty that the Services will be uninterrupted, error-free, secure, or free of viruses, worms, or other harmful components.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with these Terms or the Services (including, without limitation, the use of or inability to use the Services, or the performance or non-performance of the Services), whether based on contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total liability to you for all claims arising out of or in connection with these Terms or the Services shall not exceed the greater of (a) the total amount paid by you to us during the twelve (12) months immediately preceding the date of the claim, or (b) one hundred dollars (US $100.00).
